Tyrean manages patent portfolios of startups based on a yearly fee. An estimate to operate your portfolio is based on the information provided to Tyrean. Some of the questions follow: How many applications in the portfolio? What is the due date and status of each application? How many are at first action? How many are at final action? How many are in appeal? Once Tyrean has the data, your startup will be provided with an approximate estimate in one week. If you approve of the yearly rate that was quoted, then you will provide Tyrean with the data for the portfolio. If the client or startup requests additional modifications, Tyrean will provide you the final estimate to maintain your patent portfolio for one calendar year. |

- Shortened Statutory Period
On all prosecuted cases involving patent IP with the USPTO, the Examiner returns a response with a "shorten statutory period" which is the "free" time to respond to the USPTO. - Late Fees Due to the USPTO
Did you know that the USPTO imposes a late fee when the response falls outside the grace period? However, beware that there is another extended period where the patent application goes abandoned. In an over-simplified example, the Examiner mails the first action on the merits response on January 15, 2009. The practitioner has a grace period of three months and can respond to the Examiner by April 15, 2009 without incurring any late fees. After April 15th, the practitioner has a further three months in the penalty period before the patent application goes abandoned. There are different periods of grace period for other situations. However, for each month after this grace period, there is a late fee incurred on your behalf as indicated in the table. For the situation described above, the fee can be as much as $1,110 that you must pay. Most practitioners file at the last possible minute (in the case mentioned above, at the point just before the application goes abandoned - or six months after the Examiner's response). - Small and Large Entity
The table highlights the patent application cost of extending the grace period by one, two to five months. Note the two rightmost columns in the screenshot. The left one of the two provides the patent application cost for "large entity" status while the right one provides the patent application cost for the "small entity" status. A small entity pays half the patent application costs that a large entity does in a number of situations. A back of the envelope definition of a small entity is a company with 500 employees or less. - Tyrean Reduces Your Costs
